1. INTRODUCTION Welcome to FX Co-Producer (“the Service”), a subscription-based software application owned and operated by FenomenonX (“we,” “us,” “our”). By accessing or using the Service, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Service.
2. DESCRIPTION OF THE SERVICE FX Co-Producer is a music-prompt generation tool that assists users in creating structured prompts for AI music creation platforms. The Service does not include or provide access to any third‑party AI music platforms such as Suno, Udio, BandLab, DistroKid, or similar services.
3. SUBSCRIPTION & BILLING The Service is offered as a monthly subscription. Payment is required before access is granted. Subscriptions renew automatically each month unless canceled prior to the renewal date. Prices may change at any time without notice.
4. NO FREE TRIALS FX Co-Producer does not offer free trials. All purchases are final once processed.
5. CANCELLATION POLICY Users may cancel their subscription at any time through the customer account portal. Canceling a subscription stops the next billing cycle but does not entitle the user to any refund of previously charged amounts.
6. OWNERSHIP OF OUTPUTS Users retain full ownership of prompts and outputs they generate. Users may use their outputs commercially. However, users may NOT: – Resell, reproduce, or redistribute FX Co-Producer itself – Use FX Co-Producer to build, train, or enhance a competing product – Scrape, copy, reverse-engineer, or attempt to access proprietary systems
7. “AS‑IS” SERVICE & SERVICE AVAILABILITY FX Co-Producer relies on external APIs (including Google Gemini). Temporary downtime, slow responses, or service limitations do not qualify for refunds. The Service is provided “as available” and “as is.”
8. FAIR USE / ABUSE POLICY We reserve the right to limit, throttle, suspend, or terminate accounts demonstrating excessive or abusive usage that threatens system stability, integrity, or cost structure.
9. THIRD-PARTY LINKS, AFFILIATES & REFERRALS FX Co-Producer may recommend external tools and may include affiliate or referral links. We may receive commissions or credits at no additional cost to you. These tools are optional and operate independently of our Service.
10. PROHIBITED CONTENT & AI MISUSE You agree NOT to use FX Co-Producer to generate or assist in content related to: – Hate, violence, harassment, or harm – Illegal activities, weapons, or dangerous behavior – Adult or sexually explicit material – Extremism, misinformation, impersonation, or fraud – Violations of copyright or intellectual property laws – Attempts to circumvent AI platform rules
We may terminate access without refund for violations.
11. USER ELIGIBILITY You must be at least 18 years old to use the Service.
12. DATA & PRIVACY We collect customer account information, purchase data, authentication data, and certain analytics. We do not store payment information. See our full Privacy Policy for details.
13. LIMITATION OF LIABILITY To the maximum extent permitted by law, FenomenonX is not liable for damages relating to: – Lost profits or business – Service interruptions – Data loss – Third‑party platform failures Our total liability will not exceed the amount paid for one month of your subscription.
14. NO LEGAL, FINANCIAL, OR PROFESSIONAL ADVICE Outputs generated by FX Co-Producer are for creative purposes only. Nothing in the Service constitutes legal, financial, or professional advice.
15. MODIFICATION OF TERMS We may update these Terms at any time. Continued use of the Service after updates constitutes acceptance of the revised Terms.
